RECREATIONAL WAIVER AND DISCLAIMER OF LIABILITY PLEASE READ CAREFULLY BEFORE SIGNING THIS RELEASE LIMITS YOUR RIGHTS TO RECOVER ANY DAMAGES IN CASE OF ACCIDENT, INJURY OR DEATH A. THE RISKS OF SURFING; ASSUMPTION OF RISK. There are inherent risks of injury associate with surfing in the ocean. The ocean contains many obvious and non-obvious hazards including rip currents, reefs, rocks, the swells and waves themselves, other surfers or organisms which may pose a risk of injury to surfers. SURFING IS A DANGEROUS SPORT AND THE RISKS OF HARM CANNOT BE ELIMINATED. I agree that I voluntarily assume all risks related to my surfing and the surfing TOUR OR INSTRUCTION provided to me by DAVID ANDRADE TOLAMA, doing business as SURFINCABO.COM., a Mexican corporation, including without limitation, the risks of death, bodily injury, loss, property damage, falls, collisions with stationary objects, the unavailability of emergency medical care, or the negligence or deliberate act of another person. B. RELEASE OF LIABILITY; I hereby hold DAVID ANDRADE TOLAMA and SURFINCABO.COM., its employees and others acting on its behalf, completely harmless and not liable and release them from all liability whatsoever; and I AGREE NOT TO SUE them on account of or in connection with any claims, injuries, losses, damages, costs or expenses related to my surfing or the surfing tour or instruction provided to me by DAVID ANDRADE TOLAMA and SURFINCABO.COM., including without limitation, those based on death, bodily injury, property damage, including consequential damages. Furthermore, I hereby hold the COUNTRY of MEXICO, or other sites of surfing instruction of DAVID ANDRADE TOLAMA and SURFINCABO.COM., completely harmless and not liable and release them, their officers and employees, from all liability whatsoever and AGREE NOT TO SUE them on account of or in connection with any claims, injuries, losses, damages, costs or expenses related to my surfing, or the surfing tour or instruction provided to me by DAVID ANDRADE TOLAMA and SURFINCABO.COM., including without limitation, those based on death, bodily injury, property damage, including consequential damages. C. MISCELLANEOUS. I intend to be legally bound hereby for myself, my heirs, executors and administrators and I agree to comply with all of the rules and recommendations regarding surfing of DAVID ANDRADE TOLAMA and SURFINCABO.COM. I also represent that I am physically fit and physically able to participate in this surfing tour or instruction. I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by Mexican laws. If any portion is held invalid, then the balance of the Agreement shall remain in full force and effect. This Agreement contains my entire agreement with DAVID ANDRADE TOLAMA and SURFINCABO.COM. No other representations or statements or inducements apart from this Agreement have been made to D. MEDICAL TREATMENT: I understand that surfing means being in places away from civilization, in case of accident if is required or it is possible to DAVID ANDRADE TOLAMA and SURFINCABO.COM, will arrange medical or hospital treatment (including ambulance transportation) for me. I authorize such actions being taken and agree to meet all costs associated with such action. The undersigned has read and reviewed the above waiver letter of resignation and release of responsibility, understanding the significance of it doing it voluntarily, without malice, error and / or bad faith.
